Os princípios constitucionais gerais do Direito eleitoral | The general constitutional principles of Portuguese electoral law

Portugal é uma democracia ocidental representativa e pluralista, de forma que o modo, por excelência, de o povo exercer o seu poder é por meio do sufrágio universal, direto, secreto e periódico. Para além das Leis Fundamentais de outrora, as quais estreitavam análise na regulação das eleições dos titulares de órgãos representativos de Estado, das regiões autônomas e das autarquias locais, a Constituição Portuguesa de 1976 explicita princípios gerais do Direito eleitoral, sobretudo, no artigo 113º, embora tal dispositivo não esgote todo o alcance dos princípios gerais de direito eleitoral. Esses princípios, dentre os quais, a liberdade, a igualdade, a imparcialidade de entidades públicas, a participação na administração eleitoral, a relevância específica dos partidos políticos, a proporcionalidade, a estabilidade da lei eleitoral, a jurisdicionalidade, dentre tantos outros, são resultado da união dos caracteres técnico-jurídico e político para sinalizar a mais perfeita afirmação da democracia e da reação às desvalorizações da vontade política do povo registradas durante o “Estado Novo” lusitano. Nesse artigo, cumpre explorar os princípios gerais do Direito eleitoral, com vistas às suas funções, características, distinções, abrangência, bem como desdobramentos em domínios políticos e não políticos (direito administrativo e direito civil).
