Abstract

The present article it is a bibliographical research aiming to address the existence of the inheritance of those born by methods of Assisted Human Reproduction annual effect after the death of the donor's genetic material is approached is due to how the use of Assisted Reproduction in the Federal Constitution and the Civil Code, referring to some bills that govern the issue, as well as Resolution No. 1358 of the Federal Council of Medicine. As a result, it was shown to participate in the order of hereditary vocation children born in the circumstances under discussion, since the Civil Code to recognize the membership of such children demonstrates the concern of the legislature to adapt the legal system the scientific change. Moreover, CF/88 ensures equality among all children regardless of their origin, not allowing the exclusion of such children to participate in the order of hereditary vocation. Moreover, it is also necessary to prepare a law that treats broadly the application of methods of Assisted Human Reproduction, in particular its use before and after the death of the donor of the genetic load.
