Resumo

O presente trabalho tem como objetivo problematizar os estatutos ético e jurídico do bem ambiental no texto constitucional brasileiro, bem como justificar a configuração de um direito subjetivo fundamental ao ambiente a partir das noções de meio, natureza-projeto e patrimônio, tal como desenvolvidas na obra La nature hors la loi: l'écologie à l'épreuve du droit, de François Ost.

Abstract

This article intends to discuss the status of the environment in Brazil’s Constitution in both senses: ethical and juridical. It intends to justify the configuration of a fundamental right to environment throught the notions of meio, natureza and patrimônio, as presented in the book La nature hors la loi: l'écologie à l'épreuve du droit, by François Ost.
