Resumo

O presente artigo faz um breve resgate da história dos direitos humanos para mostrar que eles fazem parte de uma construção humana com princípios e fins definidos no tempo e posicionados no espaço. Apresenta algumas razões para justificar a construção dos direitos humanos como um processo educacional e procura demonstrar que o entendimento do papel da linguagem na reivindicação de direitos humanos é a chave para a compreensão dos direitos humanos como frutos de um desejo coletivo para fazer justiça com quem sofreu ou sofre injustiças. O objetivo do artigo, portanto, é mostrar que o restabelecimento da justiça e a não falsificação do destino das vítimas depende de uma linguagem libertadora que possibilita a testemunha condições para narrar-se no testemunho.

Abstract

The present article makes a brief rescue of human rights history to show that they are part of a human construction with the principles and purposes set in time and positioned in space. This study presents some reasons to justify the human rights construction like an educational process and tries to demonstrate that the understanding of the language role in the claim of human rights allows that they can be perceived like a result of a collective wish to make justice whom suffered or suffers unfairness. The purpose of this article, therefore, is to show that the re-establishment of  justice and the non-falsification of the victims destination depends of a liberator language that make possible the act of witnessing, conditions  to narrate itself in the witness.
