Resumo

O trabalho tematiza o lugar do direito na reprodução da sociedade de classes, oportunizando uma reflexão sobre o atual momento de crise política no Brasil e crise sistêmica do capital, tendo como mote a prisão do ex-presidente Lula. Revisamos as contribuições da crítica marxista ao analisar a forma jurídica, inclusive as possibilidades de construir algum tipo de “justiça verdadeira” no capitalismo, analisando, por fim, a investida contra os direitos dos trabalhadores no Brasil no aludido contexto atual.

Abstract

The article themathizes the place of law in the reproduction of class society, giving a reflection on the current moment of political crisis in Brazil and the systemic crisis of capital, after the arrest of ex-President Lula. We review the contributions of marxist critique in analyzing the legal form, including the possibilities of constructing some kind of “true justice” in capitalism, analysing, finally, the attacks against the worker´s rights nowadays in Brazil.
