Resumo

O autor responde a questão que serve de título ao artigo, fundamentando uma teoria crítica do Estado. Parte da premissa da historicidade do objeto Estado, justificando a possibilidade de seu conhecimento científico e de sua crítica. Atravessando diversas respostas dadas à questão-título, de Hobbes a Negri, passando por Marx e pela tradição a ele filiada (Engels, Pachukanis, Gramsci, Poulantzas), o autor não apenas confirma a premissa de partida sobre o índice temporal da configuração da relação entre Estado e sociedade, como também acumula elementos para uma resposta contemporânea capaz de orientar a superação das diversas relações de dominação cristalizadas no Estado. Abstract

The author answers the question entitling the article and offers grounds to a critical theory of the state. He assumes the premise of the historicity of the object state and justifies the possibility of its scientific knowledge and criticism. Going through various answers given to the question of the title, from Hobbes to Negri through Marx and the tradition affiliated to him (Engels, Pashukanis, Gramsci, Poulantzas), the author not only confirms his point of departure about the temporal index of the configuration of the relation between state and society, but also builds up elements to a contemporary answers able to give directions to the overcoming of the variety of relations of domination cristalized in the state.
