Direitos Reprodutivos e o Aborto: As mulheres na epidemia de Zika. / Reproductive rights and abortion: Women in the Zika epidemic

Resumo:

O artigo analisa o direito da mulher ao aborto voluntário no contexto da epidemia de zika, visando responder: Qual tem sido a discussão acadêmica recente sobre o aborto voluntário na emergência sanitária da epidemia de Zika? Como as especificidades femininas e os princípios éticos e jurídicos dos direitos reprodutivos têm sido considerados? Foram identificados nove artigos a partir de uma busca na base Scopus com a chave “abortion AND (zika OR microcephaly)” todos veiculados em revistas acadêmicas de saúde pública e bioética. Analisando as contribuições desses artigos a partir de uma perspectiva feminista, este artigo problematiza as necessárias transformações do marco legal brasileiro referente ao aborto voluntário frente à imperatividade da legislação e jurisprudência internacional dos direitos reprodutivos como direitos humanos.

Abstract:

This article analyzes women’s right to abortion in the context of the zika epidemic. It seeks to answer: what has been the academic discoursive pattern regarding the right to voluntary abortion given the health emergency brought about by the zika epidemic? How are female specificities and the ethical and legal principles of reproductive rights considered in this literature? We identified nine articles based on a search in the Scopus database with the search key “abortion AND (zika OR microcephaly)” published in public health and bioethics journals. By analyzing the articles’ contributions from a feminist perspective, this article calls into question the necessary transformations of the Brazilian legal framework given the imperativeness of the international legislation and jurisprudence of reproductive rights as human rights.
