Resumo

O objetivo geral é fazer um resgate do trâmite do litígio do Povo Xukuru de Ororubá contra o Estado brasileiro em sede da Comissão Inter-americana de Direitos Humanos. O objetivo específico é apontar o núcleo da tese jurídica construída no âmbito da litigância junto à Comissão Inter-americana de Direitos Humanos e refletir a seu respeito naquilo que está presente ou ausente na argumentação jurídica quanto à ancestralidade indígena.

Abstract

The general objective is to remember the proceedings of the litigation of the Xukuru People of Ororubá against the Brazilian State at the headquarters of the Inter-American Commission on Human Rights. The specific objective is to point out the nucleus of the legal thesis constructed at the level of litigation before the Inter-American Commission on Human Rights and reflect on it in what is present in the argument and in what is absent about ancestry.
