Resumo:
Tomando como ponto de partida que a deliberação por qualquer dos modelos de vinculação dos particulares a direitos fundamentais decorre de pressupostos metodológicos imprescindíveis, quais sejam, posições teóricas acerca da concepção de constituição, bem como da concepção mais apropriada acerca dos direitos fundamentais no ordenamento jurídico pátrio, este trabalho se envereda nos debates propostos pelas correntes do liberalismo igualitário e do comunitarismo, nas versões formuladas, respectivamente, por John Rawls e Michael Walzer. Deste confronto teórico, sucedem distintos papéis e significados atribuídos à constituição e ao seu sistema de direitos, os quais desdobram-se em modelos diversos para a vinculação dos particulares a direitos fundamentais, indicando que a fundamentação filosófica e política de qualquer opção dogmática pode torná-la mais vigorosa.

Abstract:
Taking as starting point that the resolution for any of the linking models the individuals to the fundamental rights stems from indispensable methodological assumptions, namely, theoretical positions concerning the conception of the constitution as well as the most appropriate conception about fundamental rights into national legal system , this work engages the debates proposed by the currents of egalitarian liberalism and communitarianism, in versions made, respectively, by John Rawls and Michael Walzer. From this theoretical confrontation, appeared different roles and meanings attributed to the constitution and its rights system, which unfold in various models for linking the individuals to fundamental rights, indicating that the philosophical and political foundation for any dogmatic option can make it more vigorous.
