Resumo:

Desde sua criação, o Conselho Nacional de Justiça (CNJ) sofreu diversas contestações no Supremo Tribunal Federal (STF) sobre suas atribuições e competências. Através da análise de ações judiciais propostas no STF em que se contestam medidas e decisões tomadas pelo CNJ, esse artigo investiga (i) quais são e como se transformaram, ao longo do tempo, os principais contestadores dos poderes do CNJ, (ii) os principais pontos de contestação da atuação do CNJ e (iii) os padrões observáveis de reação do STF nesse processo de judicialização de decisões do CNJ. Utilizamos esses resultados para dialogar com algumas hipóteses, propostas na literatura recente sobre o CNJ, relativas à formação da agenda do órgão e dos riscos de sua captura por interesses corporativos.

Abstract:

Since its creation in 2004, the National Council of Justice (CNJ) has been challenged many times before the Supreme Federal Court (STF).  In this paper, we analyze quantitative data on the lawsuits, in the STF’s docket, challenging measures and decisions taken by the CNJ, in order to investigate: (i) who are the main litigators against the CNJ and how they change over time; (ii) the relationship between the different powers and roles exercised by the CNJ and different patterns of litigation; (iii) observable patterns of the STF’s behavior in this ongoing process of judicialization of disputes regarding the CNJ. We conclude by using these results to engage with some recent hypotheses, found in the scholarly literature on the CNJ, on how the institution’s agenda is formed and on the risk of capture by corporatist interests.
