Resumo: O trabalho aborda a aplicabilidade do Registro de bens culturais de natureza imaterial que constituem o patrimônio cultural brasileiro, regulamentado pelo Decreto n° 3.551, de 4/08/2000, para a proteção dos conhecimentos tradicionais associados à biodiversidade. A reflexão parte da caracterização do conjunto do saber das populações tradicionais sobre a natureza como patrimônio cultural intangível. São analisados a natureza e os limites do instituto para concluir que a aplicabilidade do registro na proteção do saber tradicional é parcialmente satisfatória. Para a efetiva proteção, é preciso à construção do regime sui generis, que traga outros instrumentos complementares ao registro.

Abstract: This paper addresses the applicability of the registration of cultural intangible nature that constitute the Brazilian cultural heritage, regulated by Decree No. 3,551, of 08/04/2000, for the protection of traditional knowledge associated with biodiversity. The reflection part of the characterization of the set of knowledge of traditional peoples to nature as intangible cultural heritage. The nature and limits of the institute are analyzed to conclude that the applicability of the protection of traditional knowledge is partially satisfactory. For effective protection, it is necessary to build the sui generis regime to bring others to record additional instruments.
