Resumo: De acordo com o último censo do IBGE, a maioria da população brasileira está concentrada nos espaços urbanos. Tal realidade trouxe novos impactos e configurações administrativas, políticas, sociais, econômicas e ambientais ao espaço citadino. O resultado deste novo quadro foi que a organização do espaço urbano otimizou o bônus de estar na cidade para uma parcela da população, enquanto as outras parcelas suportaram o ônus disto, predominantemente. A reação social organizada, manifesta pelo Movimento de Reforma Urbana, incluiu na Constituição Cidadã de 1988 a Política Urbana, e desta decorre o Estatuto da Cidade. Tais documentos legais formalizam o Plano Diretor e a Gestão Democrática da Cidade como alguns dos instrumentos legais que reorientam a nova forma de gestão compartilhada entre Administração Pública e os cidadãos da municipalidade.  Ainda que existentes há mais de uma  década, tais instrumentos ainda não se encontra no melhor uso de suas potencialidades. Tendo em vista esta referencia, expõe-se a respeito dos institutos jurídicos, seu potencial de utilização e a apreciação do atual estado da arte por parte de especialistas, juristas e urbanistas a respeito do assunto.

Abstract: According to the last census of the majority of the population is concentrated in urban areas . This reality has brought new impacts and administrative , political, social , economic and environmental settings to the city space . The result of this new framework was that the organization of urban space optimized the bonus of being in the city for a portion of the population , while other parcels bore the brunt of it , mostly . Organised social reaction , manifested by the Urban Reform Movement , included in the 1988 Constitution Citizen Urban Policy and this follows the City Statute . Such legal documents formalize the Master Plan and the Democratic Management of the City as some of the legal instruments that redirect to new form of shared management between public administration and citizens of the municipality . Although existing for more than a decade , such instruments is not yet the best use of their capabilities. Given this reference , exposes himself to respect for legal institutions , their potential use and assessment of the current state of the art by experts , lawyers and planners on the subject .
