El derecho de excepción: recurso democrático ante la pandemia COVID-19 en México / The right of exception: democratic recourse to the Covid-19 pandemic in Mexico

Resumen
Ante situaciones de emergencia como las que están sufriendo muchos países en el mundo debido a la pandemia por COVID-19, es necesario reflexionar sobre la figura jurídica del estado de excepción y su relación con la democracia, todo ello a partir de la regulación jurídica internacional en la que México figura como Estado Parte y también de su regulación constitucional y legal interna que fue aplicada para hacer frente a dicha emergencia sanitaria. Así, bajo el método documental se reflexiona sobre el caso mexicano acerca de la no suspensión o restricción en el ejercicio de los derechos y garantías que prevé el artículo 29 de su Constitución Política, y, por el contrario, la aplicación de normas constitucionales y legales distintas. Se concluye que en situaciones «anormales», las categorías democráticas deben aplicarse como un parámetro general en toda aquella situación estatal cuyas características sean de excepcionalidad y que le representen una emergencia que amenace su seguridad, lo anterior con base en una «excepción democrática» apoyada en la consciencia ciudadana, más allá del cumplimiento formal de lo establecido jurídicamente y de la actuación del Estado a través de sus órganos e instituciones.

Abstract
In emergencies such as those suffered by many countries in the world due to the COVID-19 pandemic, it is necessary to reflect on the legal status of the state of emergency and its relationship with democracy, all from the international legal regulation in which Mexico is listed as a State party and also of its internal constitutional and legal regulation that was applied to address that health emergency. Thus, the documentary method reflects on the Mexican case on the non-suspension or restriction in the exercise of the rights and guarantees provided for in Article 29 of its Political Constitution, and, on the contrary, the application of different constitutional and legal rules. It is concluded that in «abnormal» situations, democratic categories should be applied as a general parameter in all that state situation whose characteristics are exceptional and representing it an emergency that threatens its security, the above based on a «democratic exception» based on citizen conscience, beyond the formal compliance with the legally established and the action of the State through its bodies and institutions.
