Resumo
Objetiva-se, neste estudo, verificar o estágio atual da conformação do mercado de transporte individual de passageiros intermediado por aplicativos, sobretudo após a nítida regulamentação pelo Estado, por meio da Lei nº 13.640/2018 e daquilo fruto do julgamento, pelo Supremo Tribunal Federal, da ADPF nº 449 e do RE nº 1054110. A problemática desta pesquisa reside em analisar se a normatização, na forma como engendrada, é suficiente para regular essa atividade econômica e pôr fim à questão, em especial do embate ente taxistas e atuantes no serviço de caronas pagas. Conclui- se que, no contexto da ordem econômica em um livre mercado, a livre iniciativa deve ser estimulada, máxime para o alargamento da concorrência e, assim, há de se cogitar, para aquele mercado, uma desregulamentação e desjuridificação sob as óticas do equilíbrio parcial e do equilíbrio urbano. Esta pesquisa tem método exploratório, abordagem qualitativa, levantamento bibliográfico e delineamento a partir da verificação documental.

Abstract
The objective of this study is to verify the current stage of the conformation of the individual passenger transport market intermediated by applications, above all, after the clear regulation by the State through, in particular, the publication of Law No. 13,640/2018 and the result of the judgment, by the Federal Supreme Court, of ADPF 449 and RE 1054110. The problem of this research lies in analyzing whether the standardization, in the way it is engendered, is sufficient to regulate this economic activity and put an end to the question, in particular, of the clash between taxi drivers and those active in the service of paid rides. It is concluded that, in the context of the economic order in a free market, free initiative must be stimulated, maximum for the expansion of competition and, therefore, it is necessary to consider, for that market, deregulation and dejuridification under the perspective of partial equilibrium and urban balance. This research has an exploratory method, a qualitative approach, a bibliographic survey and an outline based on documentary verification.
