Resumo

Existem direitos absolutos? É possível, em outros termos, relativizar e ponderar a todos os direitos assegurados constitucional e internacionalmente, de forma a se afetar, negativamente, os programas normativos que objetivam, em último grau, conceder aos indivíduos uma esfera de proteção contra o poder do Estado? Esses dois problemas constituem-se  no leitmotiv do presente trabalho, cujo principal objetivo foi o de buscar a resposta desde uma perspectiva essencialmente jurídica, tomando como norte, de um lado, o postulado da autonomia normativa do direito face a outras formas de normalização da vida social, e de outro lado, aferir, desde a própria sistematicidade e textualidade dos direitos humanos e fundamentais, se a regra da relatividade dos direitos incide, inter alia, sobre o direito a não ser torturado ou ser desaparecido. Assim, logo após delimitar o âmbito do discurso na Filosofia do Direito, bem como discutir sobre o caráter absoluto e/ou relativo dos direitos em geral, firmou-se no terceiro tópico o caráter não-restringível – absoluto – de determinados direitos. Logo após, buscou-se discutir o tema da efetividade desde a teoria da esfera do indecidível sustentada por Luigi Ferrajoli. Os métodos de pesquisa foram o crítico e o dedutivo, tendo-se adotado o procedimento da pesquisa bibliográfica.

Are there Absolute Rights? Human Rights, Autonomy of Law and Sphere of Undecidability

Abstract

Are there absolute rights? Is it possible, in other words, to relativize and ponder on all constitutionally and internationally guaranteed rights, in a way that negatively affects normative programs that aim, ultimately, to grant individuals a sphere of protection against the State? These two problems constitute the leitmotiv of the present study, whose main objective was to seek the answer from an essentially juridical perspective, taking as the north the postulate of the normative autonomy of the right vis-à-vis other forms of normalization of social life, and to check, from the very systematic and textuality of human and fundamental rights, whether the rule of relativity of rights affects, inter alia, the right not to be tortured or not to be disappeared. Thus, after defining the scope of discourse in the Philosophy of Law, as well as discussing the absolute and / or relative character of rights in general, in the third topic was established the non-restrictive-absolute nature of certain rights. Afterwards, we sought to discuss the topic of effectiveness from the sphere theory of the undecidable sustained by Luigi Ferrajoli. The research methods were the critical and the deductive, adopting the procedure of the bibliographic research.
