Resumo

A promulgação da Constituição de 1988 consolidou o sistema federativo trial. Iniciada em 1891, com a constituição republicana, o processo de construção foi impulsionado em inúmeros momentos e interrompido em dois significativos
momentos: Estado Novo e Regime Militar. Em razão deste descontínuo processo, o sistema instaurado em 1988 representa uma inovação. Nele, os Municípios gozam de autonomia até então inexistente e a eles são atribuídas diversas competências. Neste sistema, a competência para legislar sobre direito ambiental é da União e dos Estados, que devem fazê-la de forma concorrente. Aos Municípios, cabe suplementar essa legislação. Apesar de ter somente competência suplementar para legislar, a administração local detém os instrumentos
de controle do desenvolvimento urbano, tornando-se assim importante sujeito na preservação do meio ambiente. A partir dessas constatações o autor visa apresentar alguns destes instrumentos, discutir as possibilidades de interação entre os Municípios e ainda apresentar como alguns países da União
Européia estão conferindo aos governos locais competências em questões ambientais.

Abstract:

The Constitution promulgated in 1988 reaffirmed a federal system in which power is shared by three spheres of government. Initiated in 1891, when the republican constitution was approved, the formulation of the federation had many improvements over the decades and was interrupted in two, significant historical events: Estado Novo (New State) and the Military Dictatorship Regime. Due to this discontinuous process, the federal system installed in 1988 can be seen as an innovation. Within this system, the municipalities could have an anlount of autonomy that has never existed before.· In this new system, both the National Government and the States make the environmental laws and the municipality must supplement the legislation. Even though local authorities can only supplement laws, the municipality holds the instruments for urban development controI. For this reason, it has an important role on me protection of the environrnent. The objective of this paper is to introduce some of these instruments, to discuss the possibilities of interaction among the municipalities and also to demonstrate how some European countries are conferring responsibilities to local governments related to environmental lssues.
