Resumo:

O artigo analisa, por ocasião do advento da Lei n.0 11.107/05, o instituto dos consórcios intermunicipais, apresentando, inclusive, o histórico do associativismo municipal no Brasil, definindo-o como forma de organização administrativa do território e explicitando sua evolu­ ção diante das mudanças constitucionais brasileiras. Identifica o aumento das demandas locais, o surgimento de problemas não circunscritos às fronteiras territoriais dos municípios e a insu­ ficiência orçamentária destes entes federativos como causas para o desenvolvimento das solu­ ções associativas, e apresenta os modelos formulados a partir da evolução deste conceito, de modo a detalhar a construção do conceito de consórcio intermunicipal. Dedica-se, ainda, o artigo à análise jurídica do novo diploma legal, ressaltando polêmicas doutrinárias já acesas, quando ainda projeto de lei, quanto à sua adequação constitucional e a existência de antinomias referentes a outros diplomas infraconstitucionais, fornecendo subsídios críticos importantes para o estudo do tema.

Abstract

Inter-Cities joint  ventures

The article analyzes, dueto the advent of the Law nº 11.107/05, the inscitute of the inter-cities joint ventures, also presenting the description of the city association in Brazil, defining it as a form of administrative organization of the territory and detailing its evolution before the Brazilian constitutional changes. lt identifies the increase of local demands, the sprouting of not circunscribed problems to the territorial borders of the cities, and the budgetary insufficiencies of these federative bodies as causes for the development of the associative solutions. It presents the rnodels formulated frorn the evolution of association in order to detail the construction of the inter-cicies jointventure's concept. The article also rnentions the legal analysis of the new statute, by describing the doctrinal controversies that were borne by the time it was a were bill, which indudes its constitutional adequacy and the existence of antinomies to other legal norms. Finally it supplies important critical subsidies to the study of these controversies.
