Resumo

O artigo procura analisar a oportunidade e a adequação da classificação que propõe agrupar os contratos através da sua forma de execução tendo por base o tempo de duração da prestação. O texto salienta a importância da qualificação em geral a fim de determinar o regime jurídico aplicável ao contrato, ressaltando os variados critérios doutrinários diferenciadores dos contratos instantâneos e contratos continuativos. Por fim, examina as consequências jurídicas dos diferentes critérios de distinção trazidos à baila pela doutrina, buscando uma reflexão crítica sobre a relevância atual da classificação dos contratos em instantâneos e continuativos.

Abstract

The article seeks to examine the desirability and appropriateness of the classification that proposes to incorporate the contracts through its method of execution based on the duration of the benefit. The text stresses the importance of qualifications in general to determine the legal regime applicable to the contract, highlighting the varied doctrinal differentiating criteria of contracts. Finally, it examines the legal implications of the various criteria of distinction brought by the doctrine, seeking a critical reflection on the current relevance of the classification of contracts.
