Resumo: O presente artigo tem por objetivo analisar os valores que subjazem ao instituto denominado trust atribuindo-lhe um caráter teleológico, qual seja, a fidúcia e a segurança. O estudo busca esclarecer como tais valores foram depurados pelo ordenamento jurídico pátrio dando origem ao que se optou por chamar de solução brasileira para o trust, o que também se denomina “propriedade fiduciária”. Por fim, este artigo toma para si o dever de verificar se o que se tem feito é utilizar a figura do trust sob as mais diversas denominações, sem se querer admitir o reconhecimento de sua existência no Direito brasileiro.

ANALYSIS OF "ACCLIMATIZATION" TRUST OF THE BRAZILIAN LAW: THE CASE OF TRUST PROPERTY

Abstract: The presente article aims to analyze the values that underpin the “trust” institute providing for them the teleological atributes, which are “fidúcia” and security. The study seeks to clarify how those values were cleared by the Brazilian law, leading to what it was choosen to be called “Brazilian solution for the ‘trust’”, which is also denominated “fiduciary ownership”. Finally, this article aims to check if the figure of “trust”, under the most different denominations has been used, without recognizing its existence in the Brazilian Law.
