O presente artigo trata da responsabilidade política e jurídica do(s) membro(s) do Poder Executivo. O objetivo principal é delimitar as distinções entre esses dois tipos de responsabilidade, que tanto têm sido confundidas no âmbito jurídico, utilizando-se, em grande parte, da literatura do campo do Direito Constitucional. De modo a esclarecer e averiguar essa delimitação, trataremos de analisar o ordenamento jurídico brasileiro. Conclui-se pela autonomia da responsabilidade política frente à responsabilidade jurídica como manutenção de suas respectivas operabilidades.

Abstract

 The present paper aims at analyzing the political and juridical responsibility of the members of the Executive. The main objective is to distinguish between these two kinds of responsibility, which have been constantly misunderstood in the Law field. In order to examine this distinction, the Brazilian juridical order will be analyzed. It is concluded that the political responsibility is autonomous from the judicial responsibility, which is crucial to maintain their operability. Julia Kertesz Renault Pinto, Doutoranda em Direito na Universidade de Viena

Bacharel em Direito pela PUC-Rio. Possui Pós-Graduação Lato Sensu em Direitos Humanos pela Universidade de Coimbra. É mestre em Ciências Jurídico-Políticas pela Universidade de Coimbra. Doutoranda em Direito pela Universidade de Viena.
