O presente artigo realiza uma investigação histórica sobre a formação do controle de constitucionalidade no Brasil, desde a Constituição do Império de 1824 até a Constituição de 1967-69, que antecedeu a atualmente em vigor. Mais especificamente, objetiva oferecer uma crítica à narrativa do discurso constitucional brasileiro, que concebe o modelo vigente de controle judicial como produto de uma gradual evolução legislativa, cujo marco inicial se deu na Constituição de 1891. Em seu desenvolvimento, o ensaio parte de duas premissas elementares: o controle de constitucionalidade é fruto de uma decisão política, o que significa reconhecer não tratar-se de uma atribuição inerente à função do juiz ou do Poder Judiciário; em segundo lugar, a história do controle de constitucionalidade no Brasil, de certa forma, foi mistificada, de modo que se tornou hegemônica uma tradicional narrativa da linearidade de sua evolução legislativa no tempo, cuja conclusão é admitir a naturalidade de seu exercício pelo Poder Judiciário. À luz do contextualismo histórico, a pesquisa se desenvolve mediante o exame de importantes fontes históricas de cada um dos períodos constituintes, para concluir que a definição da autoridade legitimada para dizer o direito em última instância decorre de uma constelação de fatores políticos e jurídicos.

Abstract
This article realizes a historical investigation on the formation of Brazilian constitutional review, since Imperial Constitution of 1824 until the Constitution of 1967-69, which preceded the current Constitution of 1988. More specifically, it aims to offer a critique of the narrative of Brazilian constitutional discourse, which conceives the current model of judicial review as a product of a gradual evolution of legislation, whose start point was given in the Constitution of 1891. In order to develop it, this essay starts from two basic premises: constitutional review derives from a political decision, which means to recognize that it is not an inherent function of the judge or the Judiciary Power; secondly, from a certain point of view, the history of Brazilian constitutional review was so mystified that a traditional narrative of the linearity of its legislative evolution in time has become hegemonic, which, consequently, admits the naturalness of constitutional review by the Judiciary. From the historical contextualism approach, this research develops through the examination of important historical sources of each of the constituent periods, and it concludes that the definition of the legitimized authority to say the “last word” stems from a constellation of political and legal factors.
