Resumo
As inovações oriundas da lei 13.245/2016 ampliaram os direitos do advogado que atua nos inquéritos policiais. Com a nova legislação, o advogado tem o pleno acesso ao inquérito com a finalidade de instruir os seus clientes e, consequentemente, melhor preparar a defesa técnica na fase processual oportuna. O aperfeiçoamento do inquérito com vista a buscar a verdade material e o controle da atividade de investigação policial são, também, objetivos regulados pela nova legislação. Ainda que se possa discordar da tese que defende a obrigatoriedade do contraditório e da ampla defesa no inquérito policial, a lei 13.245/2016, contudo, introduziu regras jurídicas que preservam as garantais indispensáveis à consolidação do Estado de Direito e dos direitos fundamentais.

Abstract
The innovations arising from the law 13,245/2016 expanded the rights lawyer who works in the police investigations. With the new legislation, the lawyer has full access to the investigation in order to instruct their customers and thus better prepare the technical defense at the appropriate procedural stage. Improving the investigation to seek the truth material and the control of the police investigation activity are also objectives regulated by the new legislation. Although one might conclude that there is no obligation of the contradictory and full defense in the police investigation, the law 13,245 / 2016 introduced legal rules that preserve the guarantees essential to the consolidation of the rule of law and fundamental rights.
