Resumen

Este Tratado es una obra colectiva llamada a hacer historia. Sigue una estructura sistemática, con todas las características de un verdadero “tratado”, y no de los comentarios exegéticos. Esta reseña desgrana, en doce puntos, sus características principales. Tiene tres partes. La parte I está dedicada a la teoría general de los derechos constitucionales. En la parte II se estudian los derechos sustantivos en particular, comenzando por el derecho a la vida y llegando a los derechos sociales. Al final, en la parte III, se trata todo lo que rodea al debido proceso y al moderno derecho a la tutela judicial efectiva. La obra combina el estudio del Derecho dado, con soluciones innovadoras; no descuida los temas clásicos, ni ignora cuestiones novedosas en el terreno de las libertades. Ha venido ha ocupar un lugar de relevancia en la bibliografía constitucional de la región, donde se echaba en falta una obra de este calado referida a los derechos fundamentales. En esta “edad de los derechos”, el Tratado es un enorme aporte para servir a los bienes humanos. Está así llamado a dar frutos importantes, en Argentina y en otros países de Latinoamérica, para avanzar en el descubrimiento del contenido razonable de cada uno de los derechos humanos.

Abstract

This Treatise is a work that will be a landmark. It was written following a systematic approach, and not in the style of the exegetical comments. This book review shows in twelve points his principal characteristics. The book has three parts. The part I is devoted to the general theory of constitutional rights. The part II focuses in the substantive rights, starting for the right to life and finishing with the social rights. At the end, in the part III, is studied all the area of the due process and the modern right to effective court protection. This scientific work combines the study of the current Law with innovative solutions; it cares both the classical topics and the novel issues in the field of freedoms. The Treatise is coming to have a place of relevance in the constitutional bibliography of Latin America, which was lacking a work of this kind regarding the fundamental rights. In the current “age of rights”, the Treatise is an enormous contribution to the service of the human goods. This way, it is destined to give important results, both in Argentina and in other Latin American countries, in order to advance in the discovering of the essential content of the human rights.
