Resumo
O presente artigo tem por objetivo enfrentar a questão da existência de um direito comunitário do Mercardo Comum do Sul (Mercosul). Para tanto, faz-se necessário o estudo comparado entre os institutos de direito comunitário existentes no âmbito da União Européia e o ordenamento jurídico do Mercosul. Tendo em vista o caráter jurídico singular de suas instituições e de seu ordenamento jurídico, a União Européia, resultado de uma evolução histórica que teve início em meados do século passado, é, atualmente, o paradigma para todos os Estados que buscam a integração regional, como são os países integrantes do Mercosul. O sucesso do processo de integração europeu tem relação direta com a criação de um inédito direito comunitário, cujo traço peculiar é a supranacionalidade.

Abstract
The aim of this article is to face the question of the existence of a Community Law in the Common Market of the South (Mercosul). To cope with this subject it becomes necessary to carry out a comparative study between the existing institutes of Community law of the European Union in and the legal system of Mercosul. In view of the singular legal character of its institutions and its legal system, the European Union, as an outcome of a historical evolution that began in the middle of the last century, is, currently, the paradigm for all the States searching for regional integration, like the Mercosul members. The success of the European process of integration has a direct relation to the creation of a new Community law, which peculiar feature is supranationality.
