LA FORMACIÓN EN MEDIACIÓN: ALGUNAS PERPLEJIDADES DE LOS FORMADORES EN MEDIACIÓN Y DIVERSAS INQUIETUDES DE LOS ALUMNOS QUE SE FORMAN EN MEDIACIÓN

The formation Courses in mediation, considering the variety of autonomous laws that regulate them, doesn't present the requirements and uniformity that it would be desirable, at national level. It has provoked it some restlessness and perplexities, so much on the part of the own Directors of the Courses and forming in mediation (convenience of a legislation on the mediation of national environment; difficulties in the practical formation of the professional futures of the mediation), like in the own students (how to reconcile to be passive “neutral and impartial” and “facilitator” i activate; i suspect in the face of the possibility that the judge doesn't homologate the mediation agreement subscribed by the parts; excessive fear to the responsibility sanctioning - in the event of nonfulfillment of duties or causes of abstention - on the part of the professional mediator). We offer some reflections on these aspects.
