O presente trabalho teve por objetivo identificar e discorrer sobre os pressupostos jurídicos dos “direitos fundamentais coletivos e difusos” e, a partir dos mesmos, elaborar um conceito para tal modalidade normativa. Para tanto, adotou-se como principal método de trabalho o estudo da legislação nacional e a releitura de obras doutrinárias de autores como Konrad Hesse, Luigi Ferrajoli, Joaquim Gomes Canotilho, Ingo Wolfgang Sarlet, Paulo Bonavidades, Virgilio Afonso da Silva, dentre outros. Através da pesquisa realizada, ou seja, estudando-se a história, os conceitos, as funções, as dimensões e as teorias sistematizadas por Böckenförde, foi possível, não só identificar os principais pressupostos dos direitos fundamentais coletivos e difusos, mas, também, construir uma definição, a partir dos mesmos. Assim, por coletivos e difusos, pode-se entender aqueles direitos fundamentais de natureza transindividual, positivados na constituição, passíveis de tutela estatal direta, que têm por objetivo prima facie a proteção de seus titulares, compreendidos aqui, como os cidadãos em geral ou uma determinada coletividade. Logicamente, que não se pretendeu descontruir ou questionar as definições já consolidadas pela doutrina, mas, apenas, a de contribuir com os estudos e as discussões sobre esses tipos de direitos fundamentais previstos na Constituição Brasileira.

Abstract
The purpose of this study was to identify and discuss the juridical assumptions of "collective and diffuse fundamental rights" and, from them, to elaborate a concept for such normative modality. The main method of work was the study of national legislation and the re-reading of doctrinal works by authors like Konrad Hesse, Luigi Ferrajoli, Joaquim Gomes Canotilho, Ingo Wolfgang Sarlet, Paulo Bonavidades, Virgilio Afonso da Silva, among others. Through the research carried out, that is, by studying the history, concepts, functions, dimensions and theories systematized by Böckenförde, it was possible not only to identify the main presuppositions of collective and diffuse fundamental rights, but also to construct a definition, from them. Thus, by collective and diffuse, one can understand those fundamental rights of a transindividual nature, positived in the constitution, subject to direct state tutelage, whose primary objective is the protection of their holders, understood here, as citizens in general or a determined collectivity. Of course, it was not intended to deconstruct or question the definitions already consolidated by the doctrine, but only to contribute to the studies and discussions on these types of fundamental rights foreseen in the Brazilian Constitution.
