 O artigo tem o objetivo de apresentar teorias da argumentação jurídica, a partir de alguns autores (Viehweg, Perelman, Toulmin, MacCormick e Alexy), no intuito de destacar o tipo de racionalidade dessas teorias. Duas incursões críticas são feitas a essas teorias. A primeira está fundada na historicidade tal como desenvolvida por Hans-Georg Gadamer e a hermenêutica filosófica; e a segunda é resultado das reflexões sobre interioridade feitas por Sören Aabye Kierkegaard, com ênfase em dois temas, angústia e desespero. O objetivo final é propor uma discussão sobre a necessidade de pensarmos essas teorias a partir dessas duas incursões, a historicidade e a interioridade.

 Abstract

 The article aims to present theories of legal argumentation, from some authors (Viehweg, Perelman, Toulmin, MacCormick and Alexy), in order to highlight the kind of rationality of these theories. Two critical incursions are made to these theories. The first is based on historicity as developed by Hans-Georg Gadamer and philosophical hermeneutics; and the second is the result of the reflections on interiority made by Sören Aabye Kierkegaard, with an emphasis on two themes, anguish and despair. The final objective is to propose a discussion about the need to think these theories from these two incursions, historicity and interiority.
