O presente artigo tem por objetivo analisar a relação jurídica entre a indústria cultural e o fomento à cultura à luz dos direitos culturais, que são direitos humanos fundamentais resguardados pela Constituição Federal Brasileira e por diversos documentos internacionais. Nessa perspectiva, busca-se compreender o conceito de indústria cultural, analisando suas principais características, para, após, investigar como os mecanismos de fomento à cultura se relacionam com essa indústria e quais as consequências dessa associação. Mediante o uso de metodologia de pesquisa qualitativa, exploratória e descritiva, são levantadas as diretrizes internacionais, constitucionais e legais acerca do papel do Estado na promoção da cultura, buscando compreender se os atuais mecanismos de fomento estão, de fato, funcionando de acordo com tais parâmetros. Neste estudo, observou-se que o Estado não deve direcionar suas ações de incentivo à cultura sob a ótica da indústria cultural, necessariamente excludente. Ao contrário, compreende-se que a Constituição e demais normas pertinentes ao tema direcionam a atuação estatal no sentido de garantir a produção, promoção e difusão de bens culturais à luz dos princípios constitucionais culturais, garantindo a pluralidade cultural, a democratização do acesso e a continuidade das manifestações culturais que não têm espaço na indústria cultural.

Abstract
This article aims to analyze the juridical relation between cultural industry and the State’s duty to promote culture, from the perspective of cultural rights, which are fundamental human rights safeguarded by the Brazilian Constitution and also by several international documents. In this perspective, we seek to understand the concept of cultural industry, analyzing its main features so, after, we can investigate how State’s funding mechanisms to culture are related to this kind of economical concept (cultural industry) and what are the consequences of this association. By using qualitative, exploratory and descriptive research methodology, we identified the international, constitutional and legal guidelines among State's role in promoting culture, trying to understand, then, whether current funding mechanisms are, in fact, working according to such parameters, or not. In this study, it was observed that the Government should not direct its actions to encourage culture from the perspective of cultural industry, which is necessarily exclusionary. Rather, it is understood that the Constitution and other pertinent juridical rules direct the State’s action to ensure the production, promotion and distribution of cultural goods from the perspective of cultural constitutional principles, ensuring cultural diversity, and, thus, democratizing access and continuity of cultural expressions that have no place in the cultural industry.
