Resumo
O presente trabalho tem como objetivo, a partir de um estudo comparado entre o Direito Brasileiro e o Colombiano, analisar o fenômeno do estado de coisas inconstitucional, e a fragilidade dos Direitos Fundamentais socioeconômicos. Tendo em vista essa temática, tem-se como metodologia de pesquisa o levantamento bibliográfico com análise de dados, a luz dos ensinamentos de Cezar Rodriguez Garavito e Gerardo Pisarello; e ainda, como pano de fundo a ADPF 347 e a Tutela 153, que trata dos sistemas carcerários dos respectivos países. Buscou-se demonstrar a importância do diálogo entre os países latino americanos, sendo relevante compreender a literatura e as decisões judiciais inseridas em um contexto social mais próximo ao do Brasil. Nesse sentido, o Ativismo Judicial em seu possível caráter dialógico, ganha contornos mais concretos como meio de efetivação de direitos e apaziguador das criticas levantadas ao papel impositivo do Judiciário.

Abstract
This paper aims, from a comparative study between the Brazilian and Colombian law, analyze the phenomenon of unconstitutional state of things, and the fragility of socioeconomic Fundamental Rights. In view of this issue, it has as research methodology the literature with light data analysis of the teachings of Cesar Rodriguez Garavito and Gerardo Pisarello, and also against the backdrop of the ADPF 347 and Trusteeship 153, which deals with prison systems in their countries. He sought to demonstrate the importance of dialogue between Latin American countries and is relevant to understand the literature and judicial decisions embedded in a social context closer to Brazil. Accordingly, the Judicial Activism in any way possible dialogical character gains more concrete contours as a means of enforcing rights and reliever of critical raised the authoritative role of the judiciary.
